The Political Battle for the Supreme Court.
Our Founding Fathers were well aware of politics, yet they attempted to create a government that would rise above it all.
We have just crossed that line (again).
This time it was during the Brett Kavanaugh for Supreme Court hearings, part two.
I have grown accustom to the political parties and those that support them and/or their pet project/special interest to turn on the blow torch to destroy their opposition.
That kind of behavior is not new, it’s been going on for centuries. Read about the political fights that went on during Abe Lincolns time, or even at the founding of the United States.
It was down right nasty and deadly in 1800. Take some time to read about Aaron Burr and Alexander Hamilton.
The three branches of government; Legislative (Congress), Executive (President), and Judicial (Supreme Court) are both independent and dependent of each other. The Supremes are not elected like the other two so there is less of a political bent to the process of adding a judge to the court.
But in the past few years, I have observed more and more political crap including the win at all costs behavior that is usually reserved for elected offices.
Like I said, I am sadly used to all the political garbage and siding with your party stuff that has decreased the effectiveness for open and honest dialogue and discussion that leads to understanding and debates.
A couple of days before writing this, one of the most watched television events occurred, with the Senate Judiciary Committee listening to and questioning Dr. Chris Ford regarding her allegation that Judge Brett Kavanaugh had molested her when they were teens. According to Dr. Ford, there was a small gathering and she and the others were drinking. Brett attempted to remove her clothing and Brett’s friend Mark Judge jumped on the bed and interrupted what was going on which is how Christine escaped.
This incident was not reported but left a lasting memory for Dr. Ford which was recently publicly revealed this summer through a series of events that culminated in her being on TV this past week.
Judge Brett Kavanaugh, when first accused of this action flatly denied it and denied that he ever did anything wrong to women ever.
During the time between the public revelation of Dr. Fords story and the hearing last week, at least two more women made statements accusing Brett Kavanaugh of sexually inappropriate behavior and all seemed to have drinking tied to the events.
Judge Kavanaugh also denied that he ever drank to excess to the point of black outs.
So Thursday morning, the stage was set as the nation watched. Dr. Ford would go first and accuse the Judge of doing sexually inappropriate things while they were teens that could have lead to rape and she feared for her life during those brief moments. When asked, she declared with 100% certainty that the memory she shared was definitely with Brett Kavanaugh and this was not a case of mistaken identity.
It was about 3pm Thursday when Judge Brett Kavanaugh was sworn in to be questioned and I was sitting in my car, watching on my phone the live feed of the hearing. I watched the first 5 minutes or so and was very surprised at what I saw and heard.
Remember, the Supreme Court is supposed to be isolated from partisan politics, and even though there is a lot of political crap swirling around, the Supreme Court Justices are supposed to be above it all. They are to look at the laws and the various cases that are brought to their court and determine what is legal and what is not. That’s not a political stand, it’s the opposite. It’s supposed to be a cut thru the mud and listen to logic and the law and decide what it right, free of political agendas.
Now we also know that there are “leanings” of the individual judges, that some are more likely to apply a conservative or liberal interpretation of the law to the cases they hear, which is one of the reasons these seats on the court are so important. The other reason is that these are lifetime appointments.
Not many people know that Supreme Court Justices can be removed from office, that same as a president, by impeachment, but that has not happened yet. In 1801, Supreme Court Justice Samuel Chase was impeached, after then-President Thomas Jefferson accused him of bias in his decisions. The House voted to impeach, but the Senate voted to acquit. He retained his seat on the court.
Back to what I say, Crossed The Line. Judge Brett Kavanaugh rewrote his opening statement in the hours before reading it live for the hearing and the nation to hear Thursday afternoon. He crossed the line of keeping politics out of the courts.
He accused the Democratic Party and others of turning his nomination process into a political stunt and by publicly and forcefully doing this, he made it personal. Sure it was personal for him and his family, but in my mind, he just disqualified himself by jumping into the political swamp of accusations without proof just like all politicians seem to do.
At that moment, Brett Kavanaugh publicly lowered himself from being a respected, non-partisan Federal Judge, to becoming another politician throwing mud.
I caught a couple of minutes when Democratic Senator Cory Booker was asking him questions later in the day and it was the usual court room style drama where they take a statement someone said and try and twist it around to mean something else. I expected this. Both sides do this.
Later as I listened to snippets and recaps of Brett Kavanaugh being asked some pretty straight forward questions that deserved a straight forward answer and heard political speak coming out of the Judge instead.
I look forward to the truth. I, just like you, can come up with a theory and that is all it is.
I’m guessing that there is a Dr. Jeckel and Mr. Hyde complex going on. That both Dr. Ford and Judge Kavanaugh are telling the truth.
How can it be? The incident happened and Brett Kavanaugh does not remember because he was too drunk to remember. It’s that simple, and it’s my theory.
But the way this has been handled in public is terrible. It should have been handled privately to prevent the public humiliation of all.
On another side note, if my wife asked me some of the straight forward questions that were asked in these hearings and I danced around them the way Brett Kavanaugh did, I would not be a married man anymore.
For those that doubt Dr. Ford, shame on you. I have come to know over the years at least a couple women in my family who were assaulted but did not speak out at the time of the incidents. During this period in history, I have seen dozens of female friends bravely speak out that they too were in situations of almost being a victim or actually being one. As a son, husband and father, my heart grieves for those I know and those that I don’t.
The other side of this is when you are accused of doing something inappropriate that you didn’t do. That also happens and when that is the truth, then that needs to be made clear and believed also.
May we all become better and not worse on the other side of this time in our history.
